Terms & Conditions of Use

All users of this Site agree that access to and use of this Site are subject to the following Terms and Conditions and other laws which apply. Please do not sure this Site if you do not agree to these terms and conditions.

Although you may “bookmark” a particular portion of this Site or otherwise bypass this Agreement, your use of this Site still binds you to the Terms. Since the Motorcycle Safety Foundation may revise this Agreement at any time, you should visit this page periodically to review the Terms & Conditions.

Return Policy

If you wish to return an item for refund or exchange please contact the Motorcycle Safety Foundation at 949.727.3227 ext. 3023 for a Return Authorization Number. Please have your original invoice available when you call. Products approved for refund or exchange must be in new and unused condition. Only currently offered versions of publications will be accepted for return. Please include a copy of the original invoice with your return. Customers are responsible for return shipment costs. Close out and special order items are not returnable. The Motorcycle Safety Foundation cannot be responsible for items returned without a Return Authorization Number. Please contact the Motorcycle Safety Foundation at the number above if you have any questions.

All MSF products and apparel are for personal use only, and not intended for re-sale without authorized written permission in advance from the Motorcycle Safety Foundation.

Trademarks

Permission is granted to electronically copy and print hard copy portions of this site for the limited purpose of placing an order with the Motorcycle Safety Foundation or purchasing the Motorcycle Safety Foundation products. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the various areas of the site solely for your own personal, non-commercial use, or to place an order with the Motorcycle Safety Foundation or to purchase Motorcycle Safety Foundation products. Use of Site

Harassment in any manner or form on the site, including via Email and chat or by obscene or abusive language is strictly forbidden. Impersonation of others, including a Motorcycle Safety Foundation or other licensed employee, host, or representative as well as other Customers or visitors to the Site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become customers of any other commercial online service or other organization.

Participation Disclaimer

The Motorcycle Safety Foundation does not and cannot review all communications and materials posted to or created by users accessing the site and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user generated content on the site, the Motorcycle Safety Foundation is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. In an attempt to provide increased value to our visitors, the Motorcycle Safety Foundation may provide links to its sponsoring manufacturers and distributors from its own site. However, even if the manufacturer or distributor is affiliated with the Motorcycle Safety Foundation, the Motorcycle Safety Foundation has no control over these linked sites, all of which have separate privacy and data collection practices, independent of the Motorcycle Safety Foundation. The Motorcycle Safety Foundation has no responsibility or liability for these independent policies or actions and is not responsible for the privacy practices or the content of such web sites. The Motorcycle Safety Foundation respects the privacy of every individual who visits our websites. This Privacy Policy outlines the information the Motorcycle Safety Foundation may collect and how we may use that information.

The Motorcycle Safety Foundation will not collect any personally-identifiable information about you (e.g., your name, address, telephone number or e-mail address (“personal data”) through our websites unless you have provided it to us voluntarily.

If you do provide us with personal data, we may use that information in the following ways, unless stated otherwise: we may store and process that information to better understand your needs and how we can further develop and improve our MSF curriculum offerings and products; we (or another party on our behalf) may use that information to contact you in this regard. We do not now and do not intend to sell, rent or market personal data about you to third parties.

In some cases, we may automatically (i.e., not via registration) collect technical information when you connect to our site that is not personally-identifiable. Examples of this type of information include the type of Internet Browser you are using, the type of computer operating system you are using and the domain name of the website from which you linked to our site.

When you view one of our websites, we may store some information on your computer. This information will be in the form of a “Cookie” or similar file and can help us in many ways. For example, Cookies allow us to tailor a website to better match your interests and preferences. Colors

We have taken steps to display as accurately as possible the colors of our products that appear on our Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.

Products

All MSF products and apparel are for personal use only and not intended for re-sale without authorized written permission in advance from the Motorcycle Safety Foundation. Some items may be restricted to certified RiderCoaches, Chief Instructors, and/or Instructors. All purchases of such items are subject to verified certification status. There may be other additional agreements (e.g. Rider Education Recognition Program, or “RERP”) that also cover the use, distribution, and ordering of curriculum and other restricted products, and those agreements remain in full effect. In the event that restricted products are erroneously ordered or shipped, the Motorcycle Safety Foundation may cancel an order in progress, or request the return of such items.

Tax Policy

Unless the Customer provides MSF with a complete, valid, and correct tax exemption certificate applicable to the product ship-to location prior to MSF’s acceptance of the order, the Customer is responsible for sales and all other taxes associated with the order.

If applicable, a separate charge for taxes will be shown on the invoice (current State tax rate will be charged and collected by MSF on all sales in California and Pennsylvania). With respect to the state of California, MSF will additionally collect District Taxes for the County of Orange. In all other cases, the customer is responsible for remitting to their respective state, the appropriate and applicable district tax, as well as any other applicable taxes, if not charged by MSF.
